Must Muslims be just to non-Muslims and even to enemies?

The short answer

Yes. The Quran commands: "do not let the hatred of a people prevent you from being just. Be just; that is nearer to righteousness." Allah does not forbid kindness and fairness to non-Muslims who do not fight Muslims, and He loves those who are just. Oppression is forbidden against anyone.

Explanation

Justice in Islam is not reserved for friends or fellow Muslims. Allah says, "O you who have believed, be persistently standing firm for Allah, witnesses in justice, and do not let the hatred of a people prevent you from being just. Be just; that is nearer to righteousness" 1. The moment when you dislike someone is exactly when this verse applies.

Toward non-Muslims who are not at war with Muslims, the Quran goes further than neutral fairness: "Allah does not forbid you from those who do not fight you because of religion and do not expel you from your homes - from being righteous toward them and acting justly toward them. Indeed, Allah loves those who act justly" 2.

When people of another faith brought disputes to the Prophet ﷺ, he was told, "if you judge, judge between them with justice" 3. Commentators note this holds even though they were treating him as enemies 4. He was also told not to be "for the deceitful an advocate" 5: taking the side of a wrongdoer because he is "one of us" is itself injustice.

The protection is concrete. "Whoever killed a person having a treaty with the Muslims, shall not smell the smell of Paradise" 6. And in a hadith qudsi, Allah says, "I have forbidden oppression for Myself and have made it forbidden amongst you, so do not oppress one another" 7.

In daily life this means honest dealing with non-Muslim colleagues, customers and neighbours, keeping contracts with them, and speaking up when anyone, of any faith, is being wronged.

    Quran Al-Maaida · 5:8

Do not let hatred of a people prevent you from being just; justice is nearer to righteousness.

O you who have believed, be persistently standing firm for Allah, witnesses in justice, and do not let the hatred of a people prevent you from being just. Be just; that is nearer to righteousness. And fear Allah; indeed, Allah is Acquainted with what you do

    Quran Al-Mumtahana · 60:8

Allah does not forbid kindness and justice toward non-Muslims who do not fight you; He loves the just.

Allah does not forbid you from those who do not fight you because of religion and do not expel you from your homes - from being righteous toward them and acting justly toward them. Indeed, Allah loves those who act justly

    Quran Al-Maaida · 5:42

If you judge between them, judge with justice; Allah loves the just.

[They are] avid listeners to falsehood, devourers of [what is] unlawful. So if they come to you, [O Muhammad], judge between them or turn away from them. And if you turn away from them - never will they harm you at all. And if you judge, judge between them with justice. Indeed, Allah loves those who act justly

    Tafsir Al-Mukhtasar fi Tafsir al-Quran · 5:42

Judge with justice even though they are unfair and your enemies.

These Jews frequently listen to lies and consume unlawful wealth, such as usury. If they bring a case before you for judgement, O Messenger, then pass judgement between them if you wish, or leave off passing judgement if you so wish – you have the option of doing either of these. If you choose not to pass judgement, they will not be able to harm you in any way. If you do pass judgement, then do so with justice, even though they themselves are unfair and are your enemies. Allah loves those who are just in their judgements, even though the case is between those who are the judge’s enemies.

Judge by what Allah has shown you, and do not be an advocate for the deceitful.

Indeed, We have revealed to you, [O Muhammad], the Book in truth so you may judge between the people by that which Allah has shown you. And do not be for the deceitful an advocate

Allah has forbidden oppression for Himself and made it forbidden among people.

Abu Dharr reported Allah's Messenger (ﷺ) as saying that Allah, the Exalted and Glorious, said:"O My servants, I have forbidden oppression for Myself and have made it forbidden amongst you, so do not oppress one another. O My servants, all of you are astray except for those I have guided, so seek guidance of Me and I shall guide you, O My servants, all of you are hungry except for those I have fed, so seek food of Me and I shall feed you. O My servants, all of you are naked except for those I have clothed, so seek clothing of Me and I shall clothe you. O My servants, you sin by night and by day, and I forgive all sins, so seek forgiveness of Me and I shall forgive you. O My servants, you will not attain harming Me so as to harm Me, and will not attain benefitting Me so as to benefit Me. O My servants, were the first of you and the last of you, the human of you and the jinn of you to be as pious as the most pious heart of any one man of you, that would not increase My dominion in anything. O My servants, were the first of you and the last of you, the human of you and the jinn of you to be as wicked as the most wicked heart of any one man of you, that would not decrease My dominion in anything. O My servants, were the first of you and the last of you, the human of you and the jinn of you to rise up in one place and make a request of Me, and were I to give everyone what he requested, that would not decrease what I have, any more that a needle decreases the sea if put into it. O My servants, it is but your deeds that I record for you and then recompense you for. So let him who finds good, praise Allah, and let him who finds other than that blame no one but himself." Sa'id said that when Abu Idris Khaulini narrated this hadith he knelt upon his knees
